BLAZE DEVOURS BOYD HOME – Firefighters from four departments battled a blaze in the 400 block of County Road 4599 near Boyd Tuesday night, and despite the efforts of the Boyd, Paradise, Rhome and Cottondale departments, the home will likely be a total loss. Wise County Fire Marshal Chuck Beard and Assistant Fire Marshal J.C. Travis remained on scene as of 11:30 p.m. to determine the cause of the fire. The home was occupied by six people – three adults and three children, according to Lisa Fourd, one of the adults who lived in the home. The names of other family members were not available Tuesday night. The children are ages 5, 4 and 3. Fourd said the family had gone to Denton and returned to find the back of the house on fire. Her brother ran into the house to rescue the pets and tried to put the fire out with a water hose. He suffered smoke inhalation and was transported to Wise Regional Health System in Decatur. The home, owned by Donnie Johnson, was a single-story, brick structure. Beard said electrical work was being done on the house last week. American Red Cross was called to the scene to assist the family.
SEEKING ROSS’ REMOVAL – County Attorney James Stainton filed an amended petition for removal Monday in the case against suspended Precinct 4 Commissioner Terry Ross. The document, filed in the 271st District Court, calls for Ross to be removed from office without a jury trial. Last month Ross pleaded guilty to abuse of official capacity, and two other charges were dismissed as part of a plea agreement. Stainton argues in the petition that Ross’ guilty plea and misuse of government property “constitutes official misconduct,” which can result in removal from office according to Local Government Code 87.01. He also said that since Ross waived his right to a jury trial through his guilty plea in the criminal case, a jury trial shouldn’t be required for Ross’ removal. Ross sent a letter to the county demanding he be reinstated to his position with back pay and lawyer expenses. Read more in the midweek Wise County Messenger on newsstands today.
PLANS FOR INTERIM JUDGE – Precinct 2 Commissioner Kevin Burns said in Monday’s regular county commissioners meeting that they will wait to name an interim judge until after the filing period ends Dec. 9. The office became vacant when County Judge Bill McElhaney died Oct. 14. Since Burns is the senior commissioner, he will fulfill the judge’s duties in the meantime, but he does not plan to vacate his own office to fill the judge’s post. Burns suggested forming a committee at the next meeting to begin considering candidates. “I’d consider anybody who hasn’t talked to me in the last two weeks,” he said. “It was just almost inappropriate the way folks were offering themselves [following McElhaney’s death].” Read more in the midweek Messenger.
